Can see who you followed and unfollowed?

I am thinking of running a competition on my Instagram in which the winner of the competition’s profile picture will be posted to our Instagram story. We have written terms to say that by following our Instagram they are agreeing with our terms and conditions (profile picture policy is in our terms.)

My issue… what if a winner for what ever reason, unfollows our account and reports us for posting their profile picture on our story. Will Instagram be able to see if they followed our account to enter our competition which would mean they agreed with our terms? Would Instagram consider this?

I have never been reported for copy right before and don’t know how it works. Does Instagram give you any stance to defend yourself as an IG business account or do they just wipe you out meaning disable you without warning?

Any help will be appreciated,

Thanks for reading!!!

"We have written terms to say that by following our Instagram they are agreeing with our terms " I’m not a lawyer but my understanding is that this is entirely unenforcable.

That said, I don’t think there’s any way to file a copyright claim on a story.

@Iamcurtiswood I dont think u can have problems doing that, the service of unbaning are pretty poor so dont count on that to save your profile, and I dont think by following the are necessary accepting your terms even if you say it, its not valid… BUT you should be fine doing that, may not have any problems, idk why someone could report you, only if he was not aware of the draw. So before post the winner picture you could contact him to avoid problems
