Lawyers warning brands with "Insta" "Instagram" "Gram" in their names/products

Hi guys,

I´m from Germany and more and more Instagram account holders like brands, influencers, agencies, consultants, coaches receiving warnings with penalty fees to stop using the words “Insta”, “Instagram” and “Gram” in their account names, products and landing pages.

I faced that as well as I started to create ads and used “Instagram” in the product name or even on my landing page. They decline all ads violating their brand guidelines - at least in Germany. I didn´t receive a warning from a lawyer but it´s spreading at the moment.

After talking to the Facebook customer service, this is what they sent me: https://en.instagram-brand.com/

More and more Instagramers using Instagram for their business and selling Instagram services and products facing these problems now and changing their profile names and their entire portfolio especially the product names.

Are you facing similar actions in your country? I see so many american accounts with Instagram in their brand name, in ads and all their products are named after Insta/IG/Instagram/Gram etc.

Is it only in Germany so strict?

Yes, I think it’s country-based and not global. At list not at the moment.

It’s just a problem when you use Paid Facebook/Instagram Ads, changing the wording helps to get the ads through. It shouldn’t be an issue when using the word Instagram on the website or landing page as it’s hard to proove. Many websites have the word Instagram included as they want to redirect the people to their socials.

Hi Roy :blush: I know a person which got in trouble without using any ads. I will send you the account name. She is changing everything now… her brand name, product names, landing pages… I had a lot of trouble because of ads yes but it´s starting now with accounts using no ads. Using the trademark Instagram to build your business, is violating their guidelines. But I thought until today, they aren´t so strict about it. This is changing now obviously.

Yes, using gram, insta, or instagram for your business can carry legal consequences.
It’s not something new, and seems quite obvious. In any case, it’s always better to be a bit more original, isn’t it? :slight_smile:
